Lawyer Peter Brauti this week told a Toronto Police tribunal probing internal allegations of misconduct against Const. Mike Turnbull the drug squad probe was "unfair and oppressive." He is charged under the Police Services Act with refusing a lawful order to answer task force questions. Brauti's allegations came while complaining prosecutors the case have refused to disclose evidence he says is key to Turnbull's defence. Citing allegations of false immunity offers, deceit, oppressive and aggressive interviews and media leaks, Brauti said the "extremely intense and gruelling" probe has had "quite a traumatic effect" on almost a dozen officers who are in its web. Brauti said Turnbull was offered immunity from prosecution as a witness. He gave 60-pages of statements until his former lawyer, Dan Moore, became concerned the interview was illegitimately probing criminality on Turnbull's part and advised Turnbull to stop answering. Prosecutor Kimberly Greenwood said Brauti's motion is meant "merely to delay and complicate" proceedings. - --- MAP posted-by: Larry Seguin
