POT GROWER ORDERED TO LOSE HOME

A Langley Pot Grower Is Appealing A Judge's Precedent-Setting Ruling That
He Forfeit His Home.

A man ordered to hand over his house after it was found to be a marijuana
grow operation has been told by a provincial court judge to give the home
up to authorities.

Van My Luu pleaded guilty to producing pot, after his home at 2418 - 268th
St. was busted by Langley RCMP and found to be a grow op.

The house was subsequently seized.

However, Luu challenged the forfeiture of his home, and the case went to
court in April of 2005.

In an Aug. 9 ruling on the case, a judge ordered that the home to be turned
over to the Crown and disposed of by the Ministry of Public Works.

The decision is precedent-setting, said Langley RCMP, as it is the first
time a forfeiture has been contested in B.C.

Luu, who was also given a one-year custodial sentence, is appealing the
decision.
