Tyrone Cornell David, 41, showed up at his residence on St. Margarets Bay Road in Lakeside at about 11:20 p.m., according to Halifax RCMP spokesman Cpl. Scott MacRae. Under the conditions of his October 2009 bail, David is supposed to be in his apartment between the hours of 11 p.m. and 6 a.m. David spent the night in police custody and was arraigned in Halifax provincial court early this afternoon on a charge of breaching his release conditions. Federal Crown attorney Susan Bour consented to David's release on a $1,000 recognizance. As with his earlier bail, he has to report to Halifax Regional Police headquarters every Friday in person or by phone, can't have a cellphone or pager and must follow the curfew unless he's working or dealing with a medical emergency. Judge Brian Gibson ordered David to return to court Dec. 6 to enter a plea on the charge. David was first arrested Oct. 9, 2009, as he arrived at work at the Dartmouth provincial courthouse. Police allege that David had collected an envelope containing drugs from Kathleen Mary Kierans, 23, of Bedford a few minutes earlier. Investigators believed the drugs were destined to be smuggled into the Central Nova Scotia Correctional Facility in Dartmouth through the holding cells at the courthouse. Kierans's boyfriend, well-known crime figure Jimmy Melvin Jr., was in custody at the Dartmouth jail at the time. David and Kierans were both charged with three counts of conspiracy and three counts of trafficking in hashish, marijuana and Valium. David is also charged with breach of trust, accepting a bribe and 12 counts of possession of drugs for the purpose of trafficking, including hash, marijuana, Valium, heroin, hydromorphone, oxycodone, ecstasy, morphine and amphetamines. The pair have elected to be tried by a Nova Scotia Supreme Court judge and jury. A preliminary inquiry, to determine if there is sufficient evidence to proceed to trial, began last week in Dartmouth provincial court and will continue Nov. 29 and Dec. 17. David and Kierans were freed on bail last fall and ordered not to communicate with each other.
