HOA COVENANTS AND MARIJUANA

Re: "Can HOAs ban pot?," Jan. 14 news story.

You quote a HOA legal analyst as saying that the essence of covenants
is, "People can agree to things which waive their constitutional
rights." So, if HOAs are able to ban the consumption of marijuana in a
person's home, can they also ban the consumption of alcohol? What
about adultery committed within the geographic boundaries of the HOA?
Can divorced persons be banned or banished? If the analyst's broad
interpretation of the powers of HOAs is correct, then the HOA is the
most powerful institution in America.
