POT SHOP SUES MEDFORD AFTER COURT RULES FEDERAL ACT TRUMPS STATE LAW

MEDFORD (AP) - Medford's ban on pot sales is facing a lawsuit from a 
medical marijuana dispensary.

The Medford Mail Tribune reports Circuit Judge Timothy Gerking shut 
down MaryJane's Basement and Attic a year ago, saying state laws did 
not trump the federal Controlled Substances Act.

Shop owners Richard and Marlene Nuckols were allowed to reopen the 
attic portion of the store, but not the basement where marijuana was sold.

Grants Pass attorney Robert Graham is representing the business 
owners and says upholding Gerking's order effectively nullifies 
Oregon's medical and recreational marijuana laws.

Deputy City Attorney Kevin McConnell references the Controlled 
Substances Act in an answer to the lawsuit issued June 25.

Medford officials are drafting regulatory rules for dispensaries 
while the ban is still in place.
