After presenting reports from two doctors Sacramento attorney Joe Farina today moved for a continuance. Farina was joined in his motion by Placer County attorney Dale Woods who represents Steve Kubby. Judge Robert G. Vonasek, a visiting retired Glenn County judge from Orland who is presiding, found good cause that Michele Kubby. 33, could not proceed to trial. He ruled to continue the trial to February 15, 2000. Michele Kubby's medical condition stems from complications with her current pregnancy. Last fall, while her husband was the Libertarian Party candidate for governor in California, she suffered a miscarriage. A multi-jurisdictional task force stormed the Kubbys' home in Olympic Valley last January acting on an anonymous letter received months earlier. That armed task force arrested Steve and Michele Kubby and confiscated most of their valuables. After holding the couple for $200,000 bond, another judge ordered the Placer County Sheriff to release the two on their own recognizance. Both Kubbys were medical cannabis patients who had written authorization to use the substance from their doctors in accordance with Proposition 215, passed by a majority of California voters more than two years ago. Despite that Michele Kubby suspended the use of marijuana with the onset of her pregnancy. Extensive examinations of Steve Kubby at the University of Southern California under the supervision of Dr. Vincent DeQuattro conclusively prove that medical marijuana has kept Steve Kubby alive despite his rare malignant pheochromocytoma, a usually fatal cancer. "I'm grateful to the judge for putting families first," said Steve Kubby. "We'll return to the legal arena, but first I have to take care of my wife, my daughter, and my soon-to-be-born child," he concluded. - --- MAP posted-by: Richard Lake
