ANACONDA - A medical marijuana caregiving and grow operation is proposed west of Anaconda in the West Valley Development District. Property owner Johnathon Lescantz has filed for a major development permit to run the operation at 194 Maguire Road. The county planning board will hold a public hearing on the request at 7 p.m. Monday, May 9, in the courthouse courtroom. Ordinance No. 220, which went into effect last December, allows for caregiving in rural development districts, such as the West Valley or Opportunity, subject to the major development permit process. ANACONDA - Recommendations ultimately reached by Anaconda's medical marijuana task force will apply only to care-giving, while its members have decided not to allow dispensaries within the county. The task force met for the fourth time this week, already settled on some preliminary boundaries for distributing and zoning medical marijuana. Planning consultant and task force adviser Bob Horne told The Montana Standard the task force is steering clear of regulating storefronts, at least until the Legislature is able to provide more guidance in the 2004 state law. ANACONDA - A medical marijuana caregiver accused of growing more plants than legally allowed made his initial appearance Wednesday in Anaconda district court. Branden Hagerman, 27, is charged with felony criminal production of dangerous drugs after police allege he grew twice the marijuana plants permitted for his number of patients. Hagerman did not enter a plea in the absence of his attorney, Carl DeBelly, of Billings. Judge Ray Dayton set an arraignment for 10 a.m. June 16. Hagerman remains free on recognizance.
